TED NewsDesk, New Delhi: The Bar Council of India plans to appeal to Supreme Court pleading to make a minimum of three years of experience a requirement for candidates who wish to appear for the Judicial Services Exam. This demand is in line with the decision of the Andhra government to refrain fresh law graduates from sitting for the exam for Judicial Officers.
At present, the provision is to allow the fresh graduates to appear for the exam without any practice at the Bar. But recently there have been complaints regarding rude and impractical behaviour with the Bar council members and the Litigants. Both the Bar Council of India and the State Bar Council are advocating for at least three years of practical experience before allowing the candidates to sit for Judicial Services Exam.
It should be made compulsory for the law graduates, since they do not possess the understanding required for being able to handle cases as Judges, making them incompetent. The appeal by BCI is asking to change a 2002 Apex court judgment which had removed the required qualification for practice for the lower judiciary courts.
